PROBATE AND ESTATE ADMINISTRATION

Probate is the legal process whereby property is passed to a person’s heirs upon their death. Probate is also the process of going to court to set up the process to settle the estate of a person who has passed away. There are legal requirements that must be met that an experienced attorney from Culp & Little will guide the representative of the estate in completing. If there is a will the assets will be distributed according to the instructions of the decedent that determines who gets what and how much. When there is a will an executive will be the representative of the estate.

If you have a loved one who has passed away without a will or a trust, that may require the administration of the estate through the court. A personal representative will be appointed which the attorney will help oversee the process. This is a more time consuming and costly procedure, but one that Culp & Little is able to assist you with.

When one has elected to dispose of their assets through a trust rather than a traditional will, the beneficiaries will need assistance in administering the estate. The assets will still need to be gathered and the bills of the estate paid, while the remaining assets are distributed to the beneficiaries. This may include deeds to re-title any real property. Depending upon how your trust has been set up, trust administration may be an ongoing obligation for which you will need ongoing assistance. Culp & Little is able to assist you through this process.
